Settlement Scheme (EU Workers) and Key Case Law Update – Reminder

With yet another Brexit extension granted, this seemed a good opportunity to discuss how the UK Settlement scheme has been, and will no doubt continue to, operate (over the coming months at least). While some may already be moving this forward with EU and EEA staff, by encouraging them to apply for a relevant status, we will run through how the system has been functioning and why it might be worth moving this forward with staff (sooner, rather than later).

The last couple of months have also provided some interesting Tribunal cases for us to review, including, vegetarianism recently not being deemed a qualifying Equality Act “belief”. We will also discuss where this might leave veganism, in terms of whether (or not) it qualifies for protection, and what this might mean for local businesses/traders.

There has also been further case law concerning the use of suspension, where there is alleged gross misconduct, and the circumstances where this might not be deemed appropriate. Interestingly, there is also an overlap here with the law of constructive dismissal, which should provoke some interesting discussion.

Lastly, we now also have the first full 12 months of Tribunal figures, following Employment Tribunal fees being scrapped, to dissect and discuss!
