As anyone who has been involved in dealing with disciplinaries knows, they can be very fraught and take up a lot of management time.
Whilst the ACAS Code of Practice will apply, it may not always have to be followed to the strictest letter. That said, it is generally recommended that at least its substance is followed, particularly for those with two years’ service.
But, needless to say, there are various other issues which can arise during a disciplinary process.
•What if the employee goes off sick?
•What if there are not enough managers to deal with the investigation, disciplinary and appeal stages?
•How much investigation is reasonable and what is a fair sanction to impose?
•What is the difference between a “protected conversation” and a “without prejudice” conversation?
We will explore all these questions, and more, in a dedicated discussion on this problematic topic. If there is time, we can also address a few issues, surrounding how best to deal with complicated grievances.
