The death of a family member is inevitably a very difficult time for all concerned and having to deal with the winding up of their affairs, involving an application to the Court and ensuring that everything is dealt with according to the prescribed regulations, only adds to the stress involved. We have the necessary expertise to guide you through this often complex and potentially confusing process, and provide you with the advice you need in connection with the executry, tax implications and any possible claims by third parties.
Financial & Welfare Guardianships
Incapacity may arise not only with advancing years but also suddenly and unexpectedly, such as through a stroke or an accident. If you should become incapable without having made a Power of Attorney, it will be necessary for someone to apply to the Court to be your Guardian. These applications are complex, lengthy and expensive. However, we have the necessary expertise to advise a prospective Guardian in making an application to the Court for a Financial and/or Welfare Guardianship Order, or even an Intervention Order or Access to Funds Order, where these are more appropriate.
Powers of Attorney
A Power of Attorney is simply a legal document by which you authorise someone to make decisions on your behalf. This is usually done in order to enable that person to manage your affairs in the event that, in the future, you become incapable of doing so personally, but it can only be made while you have the required capacity. We have the necessary expertise to advise on the making of a Power of Attorney, as well as advising an Attorney on their powers and duties.
Wills
A Will is simply a way of ensuring that everything you own passes to the persons of your choice upon your death. If you do not make a Will, there are various legal rules that automatically determine who receives your estate and these will not necessarily reflect your wishes. The cost of dealing with your estate can also be significantly higher if you do not make a Will. A Will can also be used to appoint guardians to look after your children, ensure that your affairs are dealt with by someone you trust and reduce your exposure to inheritance tax.
