Leasing a property is an area fraught with potential difficulties. Tenants have substantial legal rights under the Housing Acts. Therefore, it is imperative that landlords have a lease professionally prepared in order to ensure that they are fully protected.
As a landlord, you may have many obligations to adhere to, for example:-.
- You are required to register as a landlord with your Local Authority under the Antisocial Behaviour (Scotland) Act 2004. All private landlords are required to register in the “Register of Landlords”, which is maintained by the Local Authority in the area in which the property is situated. The aim of the landlord registration scheme is to ensure that all private landlords are fit and proper persons to let residential property.
- You are obliged to comply with the repairing standards. The landlord requires to ensure that the property is wind and watertight and reasonably fit for human habitation. All landlords must inform tenants, in writing, regarding the standard before the start of any new tenancy.
- With effect from 4th January 2009, every property advertised for let must, by law, obtain an Energy Performance Certificate (EPC). This is a legal requirement and must be made available to all prospective tenants. The EPC will provide an energy efficiency rating for the property.
- Certain landlords may also require to apply for a House of Multiple Occupancy (HMO) Licence.
