We have a solicitor who is dual qualified in English and Scots law. If you or your former spouse or partner are living or have lived in England or Wales and are in the process of separating or divorcing you may have a choice of jurisdiction.
The law relating to children is very similar in both countries but we have the expertise to start proceedings in England if your children are living there, and vice versa. We can help in cases where children have been, or may be, removed from their usual home by one parent.
The law relating to financial matters on divorce is different in each country and it is advisable to speak to us before starting proceedings to ensure you have all the information you need. There are different approaches in each country to the definition of matrimonial property and this can make a significant difference to the outcome on divorce. If your spouse has already issued divorce or financial proceedings in either jurisdiction we can act for you throughout.
The law relating to Wills and inheritance is also different in England and Wales and if you have now moved to live in Scotland you may not be aware of the implications as far as planning your family’s future is concerned.
